Delhi High Court dismisses Gautam Gambhir’s complaint in COVID-19 medicines case

The matter was to stocking of medicines to Covid-19 during Corona.

Gautam Gambhir News: Indian men’s cricket team head coach and former MP Gautam Gambhir has got a big relief from the Delhi High Court. On Friday, the Delhi High Court dismissed a petition filed against Gautam Gambhir, one of his organizations and others on charges of alleged storage and unlicensed distribution of medicines during the Covid-19 pandemic. The court said that no concrete evidence was found in the investigation to prove that Gambhir or his foundation had taken unfair advantage of the medicines or distributed them illegally.

Justice Neena Basal Krishna said in her order, “The criminal complaint is quashed.” In fact, the Drug Control Department of the then Delhi government of the Aam Aadmi Party (AAP) had filed a complaint under Section 18 (C) and Section 27 (B) (2) of the Drugs and Cosmetics Act against the then East Delhi MP Gautam Gambhir, his NGO Foundation CEO Aparajita Singh, Gambhir’s mother Seema Gambhir and wife Natasha.

Section 18(c) of the Drugs and Cosmetics Act prohibits the manufacture, sale or distribution of unlicensed medicines, while Section 27(b)(2) provides for 3-5 years of imprisonment and fine for unlicensed distribution of medicines. Apart from former MP Gautam Gambhir, notice was also sent to Natasha Gambhir, Seema Gambhir and Aparajita Singh in this case. In September 2021, the High Court had stayed the trial court proceedings. After this, there was a round of arguments and in April 2024, the court lifted the stay.

The Drug Control Department had objected that Gautam Gambhir should have gone to the Sessions Court first and not directly to the High Court. Along with this, he argued that the Foundation has admitted that the medicines were distributed without license, but were not sold. However, the court rejected all these arguments and quashed the complaint.
